However, it’s important to note that law enforcement agencies, like the police, often have limited resources when investigating this type of crime. In such cases, they may refer you to ActionFraud, which may not have the extensive network required for prosecution and may decline to investigate further.

    The Prosecution Process

    If you know the identity of the person who has stolen your cryptocurrency, we may be able to privately prosecute them. However, the fraudster must be identified, have a UK address, and the value of the fraud must exceed £10,000.

    A summary of the process is as follows:

    1. Assemble the evidence – we gather all evidence including transaction history, bank statements, website addresses, all communications with the fraudsters and a statement from you;
    2. Review the evidence – is there sufficient evidence to prove a criminal case for fraud? The case will also be reviewed by a senior barrister.
    3. Send the case to Court – we apply to Court for permission to prosecute the fraudster. The Court drafts a summons which we serve on the fraudster who must then attend Court on a set date to plead guilty or not guilty to the criminal charge
    4. If the fraudster pleads guilty – then they are sentenced;
    5. If the fraudster pleads not guilty – then the case is referred to Crown Court and listed for a full trial.
     
    Although the primary purpose of criminal proceedings is to punish the fraudster, the courts also have wide powers to order compensation and/or Proceeds of Crime Act investigations of the financial circumstances of convicted fraudsters.

    The Civil Litigation Process

    If you have lost more than £1,500, we can review the relevant financial transactions to determine whether there has been a breach of regulations or negligence on the part of the financial institution. Our specialist team can then look to seek legal redress on a no win, no fee basis.

    Case study

    Cryptocurrency fraudster orchestrated a scam which involved persuading 27 investors to contribute their Bitcoin to trading bots and promising significant returns. The investors lost over 30BTC when the fraudster erased their online presence and removed all communication. After being turned away by both the police and ActionFraud, the investors sought legal advice from our team. The defendant pleaded guilty to seven counts of Fraud by false representation.
